Judicial Panel Agrees to Reconsider Case

The ninth circuit court of appeals ruled on Tuesday that it would reexamine the case concerning the president’s authority with an expanded panel of eleven justices. The court also vacated a earlier ruling from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Troop Deployment

This legal directive represents the latest development in a protracted court case over whether the former president has the legal right and valid reason to deploy state military units in Portland. Approximately 200 federalized guard members have been in uncertainty since late September when the deployment effort was started in response to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that federal officials at the immigration center in the southern part of the city were under attack, while local authorities assert that local officers have command of the situation.

Contrary to descriptions of the city as a conflict zone, locals have been sharing videos of scenic paths and a thriving food scene, and organizing events such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The appeals court decision came after a US district judge in Portland enacted two legal injunctions this period – one preventing the federalization of the state troops, and another prohibiting the use of any military personnel in the state, after efforts to evade the initial injunction by calling up out-of-state forces.

On Monday, the appeals court had temporarily suspended the initial decision – permitting command of 200 Oregon national guard – but the subsequent injunction stayed effective, blocking the actual deployment of the troops.

The Tuesday decision means the matter will be heard by the full court – with both rulings under review together – by a group of 11 judges.

“This decision demonstrates that facts are important and that the judicial system are striving to hold this administration accountable. The constitution restricts the executive authority, and local populations cannot be treated as a training ground for expansive government power,” stated the legal representative in a statement.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the military into American urban areas without cause. We will continue protecting state legislation, values, and sovereignty as this legal proceeding moves forward and our fight continues in the judicial system.”
